General Terms Conditions Of Tour Packages, Hotels, Diving, Snorkeling

The terms "We", "Us" refer to Sulawesi-Experience.com Company. The term "You","Your", "Client", "Participant" refers to the customer or website visitors, booking a reservation through us or otherwise using our services.
General Term Condition of Tour Packages, Hotel Accommodation, Snorkeling, Diving and others related can be read as follow :

General Term Condition of Tour Packages, Hotel Accommodation, Snorkeling, Diving and others related can be read as follow :

Tour Packages :

Price :
All price are quoted in Rupiah (IDR/Rp) or U.$. Dollar (USD) and are subject to change with / without prior notice and are subject to availability. Quoted price are Net, Non Commission and Including 21% Tax - Service Charge.

Reservations :

  1. All reservation should be made Min. 1 (one) week before date of arrival and it should be made through to our office.
  2. All reservation should be made by facsimile or email to ensure proper processing.
  3. All reservation are subject to availability at the time of booking and require confirmation.

Tour Price Included :
Hotel Accommodation, Buffet Breakfast at Hotel or Resort, Transportation, Tour as per Itinerary, Meals as per Itinerary, Guide, Entrance fee, Mineral water a long trip, Parking and Toll entrance and for marine activities it is usually including Boats, Standard Dive Equipment, Dive Boat, Snorkeling Equipment. Some of client didn't required for Lunch and Dinner, or asking to excluding Lunch only, or Dinner only (depend on client request), these meals will become personal account.

Tour Price for Children :
Rate for children under 10 years of age are 50% paying with NO BED (bed will be sharing with parent), 75% Paying with Ex. bed. Infant under 2 years of age will be free of charge but no service will be provided.

Tour Guide :
Tour guides are speaking in English, specializing in others language (such us Japanese, Germany, Italy, France, etc) are subject to request and must be have additional charge.

Cancellation :
Any cancellation should be made to our office by facsimile or email and if there any cancellation without approval from our office will be considered as “NO SHOW” and the applicable charge will included in your account.

Cancellation Fees :
In the event of cancellation of tour / travel services due to any avoidable / unavoidable reason/s we must be notified of the same in writing. Cancellation charges will be effective from the date we receive advice in writing, and cancellation charges would be as follows :

  • Cancellation tour that has been paid on 6 days before date of arrival, the cancellation fee will be 50%.
  • Cancellation tour that has been paid on 5 days before date of arrival, the cancellation fee will be 75%.
  • Cancellation tour that has been paid on 4 days before date of arrival, the cancellation fee will be 100%.

Some cancellation and refund policies are out of our tender :

  • Refund for hotel payment will follow the hotel’s cancellation policy.
  • Train tickets cancellations will follow the Railway’s policy.
  • Flight tickets cancellations will follow the airlines company policy.

Payment :
A deposit of 50% for down payment is required and should made by transfer to our bank account or use a Credit Card through Paypal once your reservation/booking status is confirmed (in accordance with the email booking confirmation). The balance of payment should be payed by Transfer, Credit Card or by Cash on Arrival. Failure to comply with this condition may result in Cancellation of all reservations.
A copy of your bank transfer should be send to us through fax or email.

Refund :

  1. No Refund and No Reduction will be made to you who does not partake in any meals, tour, hotel room, transport or transfer service.
  2. No Refund and No Reduction will be made to you who break the trip from the itinerary, regardless of whatever portions remains unused.

Liability :
We reserve the right to change the itinerary due to any unexpected operational reason or unexpected circumstances such as natural disaster, landslides, flood, traffic hold up or places of visit being closed and or others reason for saving the trip and the client.

Additional Expenses.
Additional expenses due to delay, cancel flight, accidents, medical inspection, political action or unrest must be borne by client them selves.

Hotels Accommodation :

  1. All hotel price are nett in Rupiah (IDR) or US Dollar (USD) per room per night, including of 21% taxes and service charges and are subject to change with or without prior notice.
  2. All reservation should be made by facsimile or email to ensure proper processing.
  3. All reservation are subject to availability at the time of booking.
  4. All confirmed reservations will be inform through email.
  5. Full payment its require before time limit or cut of date period, or Minimum 3 working days before check in date and should be made by transfer to our bank account or by Credit Card through Paypal once your reservations it's confirmed. Failure to comply with this condition may result in cancellation of all reservations.
  6. A copy of your bank transfer should be send to us by fax or email.
  7. Check in time : 2.00 p.m.
  8. Check Out time : 12.00 noon. Rooms requiring late check out up to 4.00 p.m. on the day of Departure will be apply additional charge of about 50% from rates, depend the hotel management or hotel/resort provider.
  9. Children under 2 years of age sharing the same room with parents utilizing existing room bedding are 50% charge from adult price.
  10. Maximum occupancy per room is 2 adults & 2 Children sharing bed with parents.
  11. If notification of cancellation is received before booking is confirmed, there will be no cancellation charge at all.
  12. Cancellation fee will be applied if the room confirmed are cancelled less than 3 - 5 working days or less than the cut of period prior to the date of arrival, the cut of date may vary depend on hotel / resort rules or hotel / resort provider.
  13. No show will be charge at one room night accordingly at hotel room rate.
  14. Room type dependent on your individual needs a selection of specifically, every rooms type may different on each hotel / resort provider.
  15. Guests are not permitted to smoke in non smoking rooms, there are additional charge from hotels, amount of charge may vary depend on hotel / resort provider rules.
  16. Breakfast is Including with the prices, and for resort it is usually including Lunch and Dinner.

Payment :

Bank and Credit Card charges fees :

  • All Bank or Paypal Fees charges are responsibility by the sender.
  • Bank Fees charges for payment transfer may vary, depend on bank and country sender.
  • Credit Card fees charge through Paypal : 4,7% per payment.

Travel Protection Plan :

While we leave no efforts to make your tour smooth and enjoyable, there may be unforeseen events and conditions such as illness, accident, inclement weather, flight cancellation, missed connection, or loss of baggage etc. Which is may cause interruption, delay or total cancellation of your trip putting your hard earned travel investment in jeopardy. It’s also possible that you may need medical assistance, emergency evacuation or medical transportation when you get ill or involve in an accident when you are traveling in remote areas. The Tour cost does not cover any of these expenses or losses and so we strongly recommend you that you should protect yourself and your travel investment against those unfavorable conditions.

Snorkeling - Diving :

Price :

Cancellation :
Any cancellation should be made to our office by facsimile or email and if there any cancellation without approval from our office will be considered as “NO SHOW” and the applicable charge will included in your account.

Diving Requirements.
Clients must dive strictly within the limits of and meeting the requirements of your current qualifications and experience and agency standards. You must not dive alone. In order to dive whilst on holiday with us, you must hold a Minimum Qualification Open Water Diver or Junior Open Water Diver or related from a recognised agency (as judged by the Company) except where you have booked a holiday, one of the purposes of which is, to obtain that minimum qualification. Clients must submit evidence of their diving qualifications to us or Dive Guide/Divemaster/Instructor or Dive center or Dive resort, If Clients have any medical condition contrary to these requirements you must produce a diving medical certificate of fitness prior to diving. If Clients fail to produce evidence of satisfactory diving qualifications or medical certificates We or Dive Guide/Divemaster/Instructor or Dive center or Dive resort, will be entitled to prevent you from taking your holiday and/or diving.
Diving activities carry inherent risks. You must behave in a fit and proper manner at all times in accordance with all recognised diving practices and procedures and take proper responsibility for your own safety. Certain diving sites are very remote, either by distance or time or both, from a recompression chamber. If you participate in such activities Clients will be asked to sign ‘liability releases & assumptions of risk’ and ‘medical disclaimer’ forms and/or provide a current medical and in all cases must adhere to the restrictions imposed by Us, Dive Guide/Divemaster/Instructor or Dive center or Dive resort.

Force Majeure and Unforeseen Circumstances.
In the unlikely event that a diving trip is cancelled due to bad weather, or rough and dangerous sea conditions, you are entitled to a get refund for the diving activities, should force majeure arises at the dive destination during the trip, we regret we cannot accept liability to pay any compensation if you suffer any damages or losses caused by it. Force majeure means any event which We or Dive Guide/Divemaster/Instructor or Dive center or Dive resort, could not foresee or avoid even with all due care. Such events may include natural disasters (hurricane, tsunami, earthquake, volcanic, flood and ect..), war or threat of war, riot, civil strife, actual or threatened terrorist activity, adverse weather conditions, political or economic disturbances, fire and all similar events outside our control.
For these condition, We will not give any compensation for that cancellation but we will provide replacement trip, base on the consent between us and clients.

Conservation.
It is becoming ever more important to conserve the natural resources, its landscapes, flora and fauna. Someone coined the phrase "Take only photographs; leave only bubbles" and a number of countries now use this to promote conservation. It would be hard to improve on this statement.
We reserve the right to cancel diving activities for any diver who does not pay reasonable care and respect for the diving environment.

Liability and Assumption of Risk.
Scuba Diving is a Potentially Dangerous Activity and Involves the risk of Serious Injury, Decompression Sickness, Embolism or other Hyperbaric Injury, Properti Damage or Lost, Death or anything related.
Clients must be follow guide safety rules and directions, must dive strictly within the limits of your current qualifications, complete any diving related forms including liability release form and Clients must be submit evidence of diving qualifications to us, or Dive Guide/Divemaster/Instructor or Dive center or Dive resort, also Clients must be in good health and not have any medical history of Lung Disorders, Asthma, Epilepsy, Diabetes or Recent Surgery, Any major operations, or any related medical sickness.
If Clients fail with these condition or a requirements, the Clients agree not to prosecute, We are cannot be held responsible, or in any way liable, for Properti Damage or Lost, Personal Losses, Serious Injury, Decompression Sickness, Embolism, Death or any related, for any reason whatsoever, whether through any activities booked through us, or caused to you buy third parties connected, or not connected to us. We will not be liable, for any additional expenses incurred by customers, for any reasons whatsoever and we are not obliged to provide you with any refund.
If you have any medical condition contrary to these requirements you must produce a medical statement prior to diving trip from your doctors or we will be entitled to prevent you from taking the diving trip.
In addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which may include physical exertion for which Clients may not be prepared, weather extremes which can subject to sudden and unexpected change, remoteness from normal medical services, and evacuation difficulties if Clients disabled.

Snorkeling Tours.
The snorkeling tours are normally in the open ocean, often in deep water, additionally the surface conditions may be choppy. Clients should be able to swim and be comfortable swimming in the open ocean. Participants should have reasonable snorkeling skills and be comfortable snorkeling in open ocean waters. It is the responsibility of participants to assess their ability level and suitability for any given snorkeling site and it’s prevailing conditions on the day and confer with the guide if problems arise. We suggest that you get out and do as much open water (ocean) snorkeling as possible before departure. This will allow your holiday to be more enjoyable.

Dive Insurance.
We recommend all client for have own Dive Insurance, DAN International is one of the good choice. We dive in extremely remote locations. Safety is a priority and we ask you to help yourself by ensuring you have the correct travel and dive insurance for everyone’s peace of mind.

Trip Cancellation Insurance.
We recommends trip insurance and specifically trip cancellation insurance. Please allow yourself extra time when booking flight schedules and check the small print of your trip insurance to avoid disappointment.

Your Responsibility.
When clients book with us, clients accept responsibility for any damage or loss caused by clients or any member of clients party. Full payment for any such damage or loss must be paid direct at the time to the accommodation or manager or other supplier. If clients fail to do so, clients will be responsible for meeting any claims subsequently made against us (together with our own and the other party’s full legal costs) as a result of your actions. We expect all clients to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of any other person in authority, clients or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without prior notice, to terminate the holiday of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the accommodation or other service. We will have no further responsibility toward such person(s) including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.

Our Responsibility :

  • We do our best to make that the traveling arrangements that we have agreed to make, perform or provide as applicable as part of our commitment with clients are made, performed or provided with reasonable skill and care.
  • We will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following: the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party or the act(s) and/or omission(s) of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable or ‘force majeure’
  • We cannot accept responsibility for any services which do not form part of our commitment. This includes, for example, any additional services or facilities which the hotel/resort or any other supplier agrees to provide for client where the services or facilities are not advertised in our itinerary and we have not agreed to arrange them and any excursion you purchase in resort. In addition, regardless of any wording used by us on our website, in any of our Information Sheets or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to clients. The commitment we made to clients about the services we have agreed to provide or arrange as part of our contract - and the laws and regulations of the country in which your claim or complaint occurred - will be used as the basis for deciding whether the services in question had been properly provided. If the particular services which gave rise to the claim or complaint complied with local laws and regulations applicable to those services at the time, the services will be treated as having been properly provided.
  • We cannot accept any liability for any damage, loss, expense or other sum(s) of any description : (1) Which on the basis of the information given to us by client concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or (2) which did not result from any breach of commitment or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally we cannot accept liability for any business losses.
